The Offense of Sexual Harassment and Its Legal Dimension
Sexual harassment is a criminal offense committed through acts of a sexual nature that disturb the victim without violating their bodily integrity. Regulated under Article 105 of the Turkish Penal Code (TPC), this offense includes sexual words, gestures, or behaviors carried out without the consent of the victim. If the perpetrator establishes physical contact with the victim, the act falls under the offense of sexual assault (TPC Art. 102). The legal framework differs for adults and children, with harsher sanctions applied in cases involving minors.

 

Elements of the Offense of Sexual Harassment
For the offense of sexual harassment to be established, the following elements must be present:

  • Sexual Intent: The act must be committed with a sexual purpose.
  • Absence of Physical Contact: The offense must occur without violating the victim’s bodily integrity. Otherwise, it is classified as sexual assault.
  • Lack of Consent: Sexual acts carried out without the explicit or implicit consent of the victim constitute a crime.
  • Disturbing Nature: The behavior must be of a nature that disturbs or unsettles the victim.

 

Types of Sexual Harassment
Under Article 105 of the TPC, sexual harassment is categorized into three main types:

  • Simple Sexual Harassment: Consists of sexually suggestive words, gestures, or behaviors directed at a person.
  • Aggravated Sexual Harassment: The penalty is increased if the offense is committed by abusing public office, a service relationship, a family relationship, workplace conditions, or through postal or electronic communication tools.
  • Sexual Harassment with Aggravated Consequences: If the victim is forced to leave their job, school, or family, the penalty is increased. In such cases, the minimum sentence cannot be less than one year of imprisonment (TPC Art. 105/2).

 

Penalties for Sexual Harassment
According to the Turkish Penal Code:
“A person who sexually harasses another shall, upon the victim’s complaint, be sentenced to imprisonment from three months to two years or a judicial fine.”

If the offense is committed against a child:
“The offender shall be sentenced to imprisonment from six months to three years.”

In this context, the option of a judicial fine applies only in cases involving adult victims; where the victim is a child, only imprisonment is imposed.

Additionally, if the offense is committed under aggravated circumstances, the penalty may be increased by up to one-half.

 

Aggravating Factors
Sexual harassment may require heavier penalties in certain circumstances. The penalty is increased when:

  • The offense is committed through abuse of public office, a service relationship, or a family relationship,
  • The offense is committed by a guardian, educator, caregiver, foster parent, or healthcare provider,
  • The offense is facilitated by working in the same workplace,
  • Postal or electronic communication tools are used,
  • The offense is committed through indecent exposure.

If, as a result of these acts, the victim is forced to leave their job, school, or family, the minimum penalty cannot be less than one year of imprisonment.

 

Legal Effect of the Victim’s Consent
Sexual autonomy is a right over which an individual may exercise control, and valid consent may eliminate the unlawfulness of the act. However, consent must be given personally by the victim, who must have the legal capacity to do so.

In cases involving mental illness or lack of legal capacity due to age, consent is not considered valid. Under the Turkish Penal Code, the consent of a child under the age of 15 has no legal validity.

For children aged between 15 and 18, the existence and validity of consent are assessed by the judge on a case-by-case basis, taking into account the specific circumstances of the incident.

 

Preventing sexual harassment and protecting victims require not only legal regulations but also increased societal awareness. Victims being aware of their rights and seeking legal remedies is a critical step in ensuring justice.
