Work Accident Compensation Lawsuits and Your Rights
Work accidents may cause employees to suffer physical, psychological, or economic harm during working hours. In such cases, compensation lawsuits may be filed to recover the material and moral damages suffered by the worker or their relatives. It is crucial to manage the legal process carefully to ensure that victims of work accidents do not lose their rights. This article outlines what you need to know about work accident compensation claims and how the process should proceed step by step.

What is a Work Accident?
According to Article 13 of Law No. 5510 on Social Insurance and General Health Insurance, the following situations are considered work accidents:

  • An accident occurring while the employee is present at the workplace belonging to the employer,
  • An accident occurring while the employee is performing work on behalf of the employer,
  • An accident occurring while the employee is sent to another location for work-related purposes,
  • An accident occurring during the time allocated for breastfeeding for female employees,
  • An accident occurring while the employee is in a transportation vehicle provided by the employer.

Steps to Take After a Work Accident
After a work accident, there are several important steps that the injured employee and their relatives should consider:

  • Avoid signing any documents prepared after the accident without careful review. Seek legal advice if necessary.
  • If there is pressure or mobbing by the employer, ensure that the documents reflect the truth. If possible, refrain from signing them.
  • When applying to a hospital, clearly state that the incident is a work accident and ensure it is recorded as such.
  • Obtain a medical report (epicrisis report) from the hospital and keep a copy.

Following these steps properly will facilitate legal support from an expert in labor law and establish a solid foundation for claiming compensation. However, there is no guarantee that every work accident case will be successful, so the process must be handled with care.

Legal Process and Rights
Individuals who suffer a work accident, or their relatives, should take the following steps to protect their legal rights:

  • Application to the Social Security Institution (SSI): Apply for temporary or permanent incapacity benefits.
  • Criminal Complaint: A complaint may be filed with the prosecutor’s office to ensure that those responsible for the accident are penalized.
  • SSI Work Accident Report: Await the preparation of the official report by the SSI, as it is a crucial document in determining the course of the case.
  • Mediation: Mediation is mandatory before filing material and moral compensation claims against the employer. However, this requirement does not apply to applications made to the SSI or criminal investigations.
  • Filing a Lawsuit: Determining the appropriate court and type of lawsuit is one of the most critical stages. Incorrect steps may result in the loss of legal rights. Therefore, it is highly recommended to proceed with an experienced labor law attorney.

How is Compensation Determined in Work Accident Cases?
When determining compensation, the judge considers several factors:

  1. Medical expenses of the worker,
  2. Loss of earnings,
  3. Loss of working capacity,
  4. Degree of fault in the accident,
  5. Duration of incapacity,
  6. Purchasing power of money at the time of the incident.

The court evaluates the extent and duration of the financial loss to determine the amount of compensation.

Types of Incapacity and Work Accidents

Permanent Incapacity:
If the worker completely loses their ability to work due to a work accident or occupational disease, a permanent incapacity benefit is granted. The rate of this benefit is determined based on the degree of loss of working capacity and whether the worker has dependents. In cases of full incapacity, the rate is generally around 70%.

Temporary Incapacity:
Temporary incapacity covers benefits paid to insured individuals who are unable to work for a certain period due to occupational disease, illness, or maternity. To receive these benefits, an application must be made to the SSI with a medical report, and the process can be followed via the e-Government system. Approved payments are made through PTT.

Time Limit for Work Accident Compensation Lawsuits
The general statute of limitations for material and moral compensation claims arising from work accidents is 10 years. However, if the incident also constitutes a criminal offense, the statute of limitations applicable to the criminal case is applied.

Work accident compensation cases generally take between 1 to 2 years to conclude, although the duration may vary depending on the nature of the case, the court’s workload, and expert evaluations.

To ensure that victims of work accidents fully receive their rights, the legal process must be handled carefully and preferably with the assistance of a qualified attorney.
